Federal Court Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody

A federal judge has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment is without legal authority.

"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.

The case originates in a mistaken removal to El Salvador in March, which the government later admitted was an error. After his return to the United States to answer alien smuggling allegations, he was detained in immigration detention.

In her order, the court pointed out that the government does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

Context of the Case

The legal challenge center on disputed claims. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.

He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing criminal case in Tennessee.

Conditions of Release

The judge, who was overseeing his challenge to deportation in a Maryland district court, determined that he must now adhere to the terms of his bond from custody in Tennessee. This decision shifts his supervision to the Tennessee court.
